TERMS AND CONDITIONS OF CZARNY KAMIEŃ RESORT & SPA

§1 General Provisions

  1. These Terms and Conditions (hereinafter referred to as the "Terms") define the scope of services provided by Czarny Kamień RESORT & SPA, the responsibilities and rules for staying at Czarny Kamień RESORT & SPA, and are an integral part of the agreement concluded by signing the registration card or performing the activities described in § 2 of the Terms (hereinafter referred to as the "Agreement"). The Terms also specify the types, scope, and conditions of electronic services provided by Czarny Kamień RESORT & SPA.

Czarny Kamień RESORT & SPA, located in Szklarska Poręba at Wojska Polskiego 11, 58-580 Szklarska Poręba, is operated by ART-DOM Developer sp. z o.o. headquartered in Jelenia Góra at Szkolna 5/10, 58-500 Jelenia Góra. The registration files are maintained by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division of the National Court Register, under number KRS0000306359, NIP: 6112646271, REGON: 020715829.

§ 2 Apartment Reservation and Conclusion of Agreement

  1. Czarny Kamień RESORT & SPA provides on the website at https://www.czarnykamien.pl/ (hereinafter: the "Website") a reservation system (hereinafter: the "Reservation System") through which it is possible to make a remote apartment reservation (hereinafter: the "Reservation") and conclude an Agreement with Czarny Kamień RESORT & SPA.
  2. To make a Reservation, the person booking should follow the instructions in the Reservation System, including selecting the offered service(s) they are interested in, according to the description and price, by clicking the "Reserve" button under the service displayed in the Reservation System, fill out the reservation form, then confirm and submit the Reservation by clicking the "RESERVE with obligation to pay" button.
  3. The booker can choose the offered service, including standard stay or stay package, as well as additional services. Price and service details are provided in the Reservation System next to the services offered. Prices shown are in Polish zloty and are gross prices including VAT. Apartment rental prices include utilities (gas, electricity, water) but exclude the local tax, which is charged to Guests staying longer than one night for leisure, training, or tourism purposes in Szklarska Poręba, according to the city council's resolutions on local tax.   4. The booker fills out the reservation form, including: a. their name, email address, and phone number, b. billing data if an invoice is desired, c. choice of payment method.
  5. Making a Reservation requires providing personal data marked as required in the reservation form. Providing this personal data is voluntary but necessary to complete the Reservation.
  6. Making a Reservation requires reading and accepting the Reservation Terms and Cancellation Policy by checking the appropriate box in the reservation form. Not accepting the Terms prevents making a Reservation.
  7. The booker may edit the data entered in the reservation form until clicking the "RESERVE with obligation to pay" button.
  8. After selecting the offered service(s) and filling the reservation form, a summary of the Reservation is displayed in the Reservation System, including information about the required deposit (the "Deposit") or full payment needed to confirm the Reservation according to the service conditions chosen by the booker.
  9. The booker confirms the Reservation by clicking "RESERVE with obligation to pay" and paying the Deposit or full price depending on chosen service conditions. If a Deposit is paid, the remaining amount is due on arrival at Czarny Kamień RESORT & SPA reception before the stay begins.
  10. Czarny Kamień RESORT & SPA offers the following payment methods for reservations: a. electronic payment by credit card, fast online transfer or using the “Blik” system via the external Przelewy24 payment system, b. traditional bank transfer, c. for reservations with less than 24 hours before realization (stay and/or SPA treatments), electronic payment via BLIK system is available. The booker provides the BLIK code by phone with security rules observed, and payment is authorized at the service provider's terminal using the external E-Service payment system. Booker cannot combine these payment methods.
  11. If the electronic payment method is chosen (credit card, fast online transfer, or Blik), payment of the Deposit or full price must be made immediately after clicking the "RESERVE with obligation to pay" button. If traditional bank transfer is chosen, payment must be made within 48 hours upon receipt of the Preliminary Reservation Confirmation email from Czarny Kamień RESORT & SPA (see clause 14 below). Failure to pay causes automatic cancellation.
  12. For orders realized in less than 24 hours from booking (stay and/or SPA), payment via BLIK must be made immediately during telephone conversation. The BLIK code must be provided by phone according to safety rules, and then payment is authorized at the service provider's terminal via E-Service.
  13. The terminal accepting BLIK codes is operated by E-Service Electronic Payment Services Center Limited Liability Company, registered in the National Court Register (KRS) under number 0000490970. Company tax identification number (NIP) is 1181477610, REGON number is 016107240.
  14. Electronic payments (credit cards, fast online transfers, and "Blik" system) via the external Przelewy24 system are handled by PayPro Joint Stock Company located at Pastelowa 8, 60-198 Poznań, registered in the National Court Register conducted by the District Court Poznań Nowe Miasto and Wilda, 8th Commercial Division under number KRS 0000347935, VAT number 7792369887, REGON 301345068, registered with the Polish Financial Supervision Authority under registration number IP24/2014, trading under the name
