SPA TREATMENT RM RULES: CZARNY KAMIEŃ RESORT & SPA

These Rules were created for your safety and comfort, primarily to protect the health of all SPA users. Please read and follow them. Using a SPA treatment constitutes acceptance of these Rules.

§1 General provisions

  1. These Rules govern use of the SPA treatment rooms at Czarny Kamień RESORT & SPA in Szklarska Poręba, ul. Wojska Polskiego 11, 58-580 Szklarska Poręba, operated by ART-DOM Developer sp. z o.o., registered in Jelenia Góra at ul. Szkolna 5/10, 58-500 Jelenia Góra, whose registration files are held by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division of the National Court Register, KRS0000306359, NIP: 6112646271. These Rules are hereinafter referred to as the “Rules”.
  2. The SPA treatment room at Czarny Kamień RESORT & SPA is managed by ART-DOM Developer sp. z o.o., registered in Jelenia Góra at ul. Szkolna 5/10, 58-500 Jelenia Góra, KRS0000306359.
  3. SPA services are available to guests of Czarny Kamień RESORT & SPA and non-resident clients (hereinafter: “Guests”).
  4. These Rules apply to all Guests on the SPA premises.
  5. Please read the Rules before entering the SPA. They are available at the Czarny Kamień RESORT & SPA reception, in the SPA room and at www.czarnykamien.pl.
  6. SPA services are payable according to the price list offered by Czarny Kamień RESORT & SPA (hereinafter: “SPA MENU”), except services covered by a Reservation purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA—so-called package treatments.
  7. The SPA MENU is available at the Czarny Kamień RESORT & SPA reception, in the SPA room and at www.czarnykamien.pl.
  8. Czarny Kamień Resort & SPA is not a sanatorium; its treatments are cosmetic and relaxing.

§2 SPA treatment room rules

  1. The SPA room is a relaxation area. Silence and quiet are required. For Guests’ comfort, please do not bring mobile phones into the SPA room or switch them off.
  2. SPA services are available to adults. Guests under 18 may use the SPA only with written consent from a legal guardian. Guests aged 13 and over may use services intended for their age group only with such consent.
  3. The SPA room may be used only during opening hours. The massage room provides services Monday to Sunday, 10:00–20:00 (depending on season/occupancy, service days and hours may change).
  4. The SPA reserves the right to change treatment room opening hours and the schedule of SPA activities.
  5. For comfort, Guests are advised to arrive for treatments in a bathrobe provided in every apartment. Most treatments are performed without clothing, always wearing underwear. Before treatment, Guests receive disposable treatment underwear.
  6. Before treatment, a warm shower is recommended for greater relaxation and comfort. To improve treatment effectiveness, drink plenty of still water before and after treatment, avoid heavy meals and alcohol beforehand, and avoid sunbathing immediately before and after treatment.
  7. To avoid irritation, men planning facial treatments in the massage room should shave at least 12 hours before the appointment.
  8. To avoid irritation, Guests planning body treatments in the SPA room should wax or depilate no later than one day before the appointment.
  9. To ensure comfort before a body treatment, avoid heavy meals.
  10. SPA services are cosmetic or relaxing treatments, not healthcare services. Results depend on factors such as health, age and number of treatments.
  11. Guests planning to use SPA services should be aware of their health and avoid treatments that could endanger life or health. Selected treatments should be used only when there are no health contraindications. Before treatment, Guests must complete and sign the consultation form, providing truthful health information.
  12. General contraindications apply, especially to body treatments and massages. Main contraindications include: Guests should consult a doctor before using massage room services.
    • implants in the body,
    • heart defects,
    • a pacemaker,
    • past heart attack,
    • fresh scars,
    • unhealed wounds,
    • skin inflammation,
    • haematomas and aneurysms,
    • skin hypersensitivity,
    • fungal infection,
    • warts,
    • epilepsy,
    • vein diseases, including varicose veins,
    • thrombophlebitis,
    • advanced hypertension,
    • atherosclerosis,
    • cancer,
    • diabetes,
    • a tendency to haemorrhage or bleeding, haemophilia,
    • acute or subacute inflammation,
    • advanced osteoporosis,
    • infectious respiratory diseases,
    • pneumonia, bronchitis,
    • asthma,
    • fever,
    • early recovery after fracture/sprain/dislocation,
    • early post-medical procedure period,
    • rheumatic conditions,
    • breastfeeding.
  13. SPA treatments are provided to pregnant women only upon presentation of written consent from their doctor before the planned treatment.
  14. If feeling unwell or experiencing discomfort during a treatment, the Guest must immediately inform the person performing it.
  15. The following are prohibited in the SPA:
    1. smoking tobacco or other intoxicants,
    2. smoking e-cigarettes,
    3. bringing in or consuming alcohol, drugs or other intoxicants,
    4. bringing in or consuming food,
    5. bringing in own fragrances or scented substances,
    6. performing cosmetic treatments independently,
    7. behaviour disturbing the calm atmosphere,
    8. behaviour generally considered indecent or offensive,
    9. recording sound or images, taking photographs,
    10. tampering with SPA equipment, k. bringing in animals.
  16. Persons under the influence of alcohol, drugs or other intoxicants may not stay in the SPA.
  17. Persons in the SPA must follow staff instructions.
  18. SPA staff may refuse entry or ask a person to leave if they:
    1. are under the influence of alcohol, drugs or other intoxicants,
    2. disturb the relaxing atmosphere,
    3. fail to follow SPA staff instructions,
    4. otherwise breach the Regulations.

§3 Booking and contract conclusion

  1. Before booking a SPA treatment, the Guest should read the Regulations.
  2. A SPA treatment may be booked:
    1. in person: Czarny Kamień RESORT & SPA reception
    2. by telephone at: +48-533-352-215,
    3. by email at: spa@czarnykamien.com.
  3. To book a SPA treatment, the Guest must provide: apartment number, first and last name, treatment type and preferred date. The service contract between the Guest and Czarny Kamień RESORT & SPA is concluded when the Guest receives booking confirmation from Czarny Kamień RESORT & SPA.
  4. A Guest entitled to a treatment under a purchased special offer/stay package included in a Reservation and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA should, immediately after purchase, contact the SPA by phone at +48-533-352-215 or by email at: spa@czarnykamien.com to book a convenient date, taking into account the hours specified in these Regulations (§6, item 3), i.e. 10:00 – 15:00, when such treatments are provided.

    If the Guest does not make contact, the SPA reserves the right to set the service date, otherwise the service may not be provided at another time.
  5. Guests from outside our property must pay a PLN 110 deposit per treatment to make a booking.
  6. The Guest should arrive at the SPA reception 5 minutes before the scheduled treatment. If late, SPA staff may shorten the treatment without granting a discount.
  7. Before a SPA treatment, the Guest must complete and sign the consultation form, providing truthful health information. The form includes:
    1. providing first and last name and apartment number,
    2. providing health information and consenting to Czarny Kamień RESORT & SPA processing health data to provide SPA services,
    3. confirming having read the Regulations and consenting to the treatment,
  8. Failure to complete, incomplete completion or failure to sign the consultation form prevents use of the SPA treatment.
  9. The Guest may cancel a booked SPA treatment no later than 24 hours before the planned treatment without a cancellation charge (excluding treatments under a purchased special offer/stay package included in a Reservation and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA). Cancellation must be reported to the Czarny Kamień RESORT & SPA Reception, by email at: spa@czarnykamien.com or by phone at: +48-533-352-214. If cancelled less than 24 hours before the planned treatment, or if the Guest fails to attend through their own fault, Czarny Kamień RESORT & SPA will charge PLN 110 for each commenced reserved treatment hour. Absence fee: PLN 110.
  10. Payment for SPA services must be made at the Czarny Kamień RESORT & SPA reception after the treatment.

§4 Liability

  1. The Guest is liable for damage caused through their fault, including damage caused by minors under their care, under generally applicable law, in particular the Civil Code.
  2. Czarny Kamień RESORT & SPA is liable to the Guest for proper performance of SPA services under generally applicable law, including the Civil Code.
  3. SPA staff are not liable for personal belongings left in the SPA area.

§5 Personal data protection

  1. The controller of Guests’ personal data processed in the massage room (hereinafter: “Personal Data”) is: ART-DOM Developer sp. z o.o., registered in Jelenia Góra at: ul. Szkolna 5/10, 58-500 Jelenia Góra, KRS number 0000306359, email: biuro@artdomdeveloper.pl,
  2. The controller processes Personal Data for the following purposes:
    1. concluding and performing a service contract (legal basis: Art. 6(1)(b) GDPR),
    2. handling complaints (legal basis: Art. 6(1)(b) GDPR),
    3. establishing, pursuing or defending against claims (legal basis: Art. 6(1)(f) GDPR), which constitutes the controller’s legitimate interest.
  3. The Controller of health-related Personal Data is ART-DOM Developer sp. z o.o., based in Jelenia Góra at ul. Szkolna 5/10, 58-500 Jelenia Góra, KRS No. 0000306359. Processing is based on the Guest’s consent, given to perform the service agreement (legal basis: Art. 9(2)(a) GDPR).
  4. Detailed information on all purposes of Personal Data processing and protection principles is included in the massage room consultation form, completed by the Guest before using the SPA service.
  5. Providing the Personal Data requested on the consultation form, including health data and consent to its processing, is voluntary, but necessary to use SPA services. Failure to provide the surname or apartment number, treatment type or preferred date makes booking the treatment impossible.

  7. Everyone whose Personal Data is processed has the right to:
    1. access their Personal Data,
    2. complete and correct their Personal Data,
    3. erase their Personal Data,
    4. restrict processing of their Personal Data,
    5. object to processing of their Personal Data,
    6. data portability,
    7. withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.
  8. If personal data protection rules are breached, the data subject may lodge a complaint concerning processing of their Personal Data with the President of the Personal Data Protection Office. The complaint may be submitted in person at the Office at ul. Stawki 2, 00-986 Warsaw, or sent to the Office’s address given above.

§6 Final provisions

  1. In these Regulations, “Czarny Kamień RESORT & SPA” means, depending on context, the Czarny Kamień RESORT & SPA facility or the company managing the Parking, specified in § 1(2) of the Regulations.
  2. Treatments purchased under a special offer/stay package, covered by a Booking and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA, cannot be exchanged for other services available at the SPA.
  3. Treatments purchased under a special offer/stay package (package treatments), covered by a Booking and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA, are provided from 10:00 - 15:00.
  4. Prices of treatments purchased under a special offer/stay package, covered by a Booking and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA, are not subject to discounts from concurrent promotions for services available at the SPA.
  5. Package treatments not used on the agreed date expire.
  6. Matters not regulated by these Regulations, including complaints procedures, are governed by the Czarny Kamień RESORT & SPA Regulations and generally applicable law, in particular the Civil Code. The Czarny Kamień RESORT & SPA Regulations are available at the Czarny Kamień RESORT & SPA reception and at www.czarnykamien.pl.
  7. All requests, comments and complaints may be submitted at the Czarny Kamień RESORT & SPA reception, in person or by phone at: 75 769 38 54 or 536 150 150, by email at recepcja@czarnykamien.com, or in writing to: Czarny Kamień RESORT & SPA, ul. Wojska Polskiego 11, 58-580 Szklarska Poręba.
  8. The Regulations apply from 01.08.2024.
