SPA CABINET REGULATIONS AT CZARNY KAMIEŃ RESORT & SPA

These regulations have been created with your safety and comfort in mind. They primarily serve to protect the health of every user of the SPA area. Please familiarize yourself with the content of the Regulations and adhere to them. Using a treatment in the SPA area equates to reading and accepting these regulations.

§1 General provisions

  1. The Regulations define the rules for stay and use of the SPA cabinets within Czarny Kamień RESORT & SPA located in Szklarska Poręba at Wojska Polskiego Street 11, 58-580 Szklarska Poręba, operated by ART-DOM Developer sp. z o.o. based in Jelenia Góra, at Szkolna Street 5/10, 58-500 Jelenia Góra, with registration files maintained by the District Court for Wrocław-Fabryczna in Wrocław, IX Economic Department of the National Court Register, under number KRS0000306359, NIP: 6112646271. These regulations shall hereinafter be referred to as the "Regulations".
  2. The SPA cabinet at Czarny Kamień RESORT & SPA is managed by ART-DOM Developer sp. z o.o. with its seat in Jelenia Góra, at Szkolna Street 5/10, 58-500 Jelenia Góra, KRS number 0000306359.
  3. SPA cabinet services are available to guests of Czarny Kamień RESORT & SPA and clients from outside the facility (hereinafter referred to as "Guests").
  4. The Regulations apply to all Guests present within the SPA cabinet premises.
  5. Before entering the SPA cabinet premises, please familiarize yourself with the Regulations. The Regulations are available at the reception of Czarny Kamień RESORT & SPA, in the SPA cabinet, and on the website at www.czarnykamien.pl.
  6. Using the services of the SPA cabinet is paid, according to the price list of services provided by the SPA cabinet offered by Czarny Kamień RESORT & SPA (hereinafter referred to as "SPA MENU"), except for SPA cabinet services covered by a Reservation purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA – so-called package treatments.
  7. The SPA MENU is available at the reception of Czarny Kamień RESORT & SPA, in the SPA cabinet, and on the website at www.czarnykamien.pl.
  8. Czarny Kamień Resort & SPA is not a sanatorium facility, and the treatments performed are cosmetic and relaxation treatments.

§2 Rules for using the SPA cabinet

  1. The SPA cabinet is a relaxation zone. Silence and calm must be maintained. To ensure Guests' relaxation, it is asked not to bring mobile phones into the SPA cabinet or to switch them off.
  2. SPA cabinet services may be used by adult Guests. Minor Guests under 18 may use the SPA cabinet only with written consent from a legal guardian. Minors who are 13 or older may use services intended for their age category only with written consent from a legal guardian.
  3. One may stay in the SPA cabinet only during its opening hours. The massage cabinet provides services from Monday to Sunday, from 10:00 AM to 8:00 PM (depending on the season/occupancy, days and hours of service may change).
  4. The SPA zone reserves the right to change the opening hours of the cabinets and the schedule of classes held in the SPA.
  5. For Guests’ comfort, it is recommended to arrive for treatments in the SPA cabinet wearing a bathrobe, which is provided in every apartment. Most SPA cabinet treatments are performed without clothing - always in underwear. Before the SPA treatment, the Guest receives disposable treatment underwear.
  6. Before the SPA treatment, it is recommended to take a shower with warm water for better relaxation and comfort. To enhance treatment effectiveness, it is advised to drink plenty of non-carbonated water before and after the treatment, avoid heavy meals and alcohol before the planned treatment, and avoid sunbathing immediately before and after the treatment.
  7. To avoid irritation, Gentlemen planning to use facial treatments in the massage cabinet should shave at least 12 hours before the scheduled treatment.
  8. To avoid irritation, Guests planning to use body treatments in the SPA cabinet should depilate at least one day before the scheduled treatment.
  9. For comfort before body treatments, it is recommended to avoid heavy meals.
  10. Services provided by the SPA cabinet are cosmetic or relaxation treatments and are not health services. Treatment effects depend on many factors such as health condition, age, number of treatments performed.
  11. A Guest planning to use SPA cabinet services should be aware of their health condition and refrain from treatments that may threaten their life or health. A Guest should use selected treatments only if they have no health contraindications. Before commencing treatment, the Guest should complete and sign a consultation form by providing truthful information about their health condition.
  12. There are general contraindications for using SPA cabinet services, especially body treatments and massages. The main contraindications include (Guest should consult a doctor before starting massage services):
    • implants in the body,
    • heart defects,
    • having a pacemaker,
    • post-heart attack condition,
    • fresh scars,
    • unhealed wounds,
    • skin inflammations,
    • hematomas and aneurysms,
    • sensitive skin,
    • fungal infections,
    • warts,
    • epilepsy,
    • vein diseases including varicose veins,
    • thrombophlebitis,
    • advanced hypertension,
    • atherosclerosis,
    • cancer diseases,
    • diabetes,
    • tendency to bleeding, hemophilia,
    • acute or subacute inflammations,
    • advanced osteoporosis,
    • infectious respiratory diseases,
    • pneumonia, bronchitis,
    • asthma,
    • fever,
    • early period after fracture, sprain, dislocation,
    • early period after medical procedure,
    • rheumatic conditions,
    • breastfeeding.
  13. Treatments in the SPA cabinet are performed on pregnant women only upon submission of written consent from the attending physician before the planned treatment.
  14. If a Guest feels unwell or uncomfortable during the treatment, they should immediately inform the person performing the treatment.
  15. The following are prohibited on the SPA cabinet premises:
    1. smoking tobacco or other intoxicating substances,
    2. smoking e-cigarettes,
    3. bringing and consuming alcohol, drugs, and other intoxicants,
    4. bringing and consuming food products,
    5. bringing personal aromas, scented substances,
    6. performing cosmetic treatments independently,
    7. behavior disturbing the relaxing atmosphere,
    8. behavior considered indecent or offensive,
    9. recording sound or images, photographing,
    10. tampering with devices constituting SPA cabinet equipment, including introducing animals.
  16. Persons under the influence of alcohol, drugs, or other intoxicants are not allowed to stay on the SPA cabinet premises.
  17. Persons present in the SPA cabinet should follow the staff's instructions.
  18. SPA cabinet staff has the right to refuse entry to or request the departure of a person who:
    1. is under the influence of alcohol, drugs, or other intoxicants,
    2. disrupts the relaxing atmosphere,
    3. does not follow the staff’s instructions,
    4. otherwise violates the provisions of the Regulations.

§3 Reservation and conclusion of contract

  1. Before making a treatment reservation at the SPA cabinet, the Guest should familiarize themselves with the Regulations.
  2. SPA treatment reservations can be made:
    1. in person at the reception of Czarny Kamień RESORT & SPA,
    2. by phone at: +48-533-352-215,
    3. via email at: spa@czarnykamien.com.
  3. To make a SPA treatment reservation, the Guest should provide: apartment number, their full name, type of treatment, and preferred treatment date. A service provision agreement between the Guest and Czarny Kamień RESORT & SPA is concluded upon the Guest receiving confirmation of the treatment reservation from Czarny Kamień RESORT & SPA.
  4. Guests entitled to treatments under a purchased special offer/stay package, covered by a Reservation and purchased under an apartment rental agreement with Czarny Kamień RESORT & SPA, should, after purchase, promptly contact the SPA cabinet by phone at +48-533-352-215 or by email at spa@czarnykamien.com to reserve a convenient date considering the hours specified in these regulations (§6, point 3), i.e. 10:00 AM – 3:00 PM, during which such treatments are performed.

    In case the Guest fails to contact, the cabinet reserves the right to set the service date under penalty of non-performance in a different term.
  5. Guests from outside our facility are asked to pay a deposit of 110 PLN per treatment to make a reservation.
  6. Guests should arrive at the SPA cabinet reception 5 minutes before the scheduled treatment time. In case of lateness, SPA staff reserve the right to shorten the treatment time without granting any discount for the service provided.
  7. Before starting the treatment, the Guest must complete and sign a consultation card providing truthful information about their health condition. Completing the consultation card includes:
    1. providing their full name and apartment number,
    2. providing health-related information and consenting to the processing of health data by Czarny Kamień RESORT & SPA to perform SPA cabinet services,
    3. confirming having read the Regulations and consenting to the treatment.
  8. Failure to complete the consultation card fully or to sign it prevents access to SPA cabinet services.
  9. A Guest has the right to cancel a SPA treatment reservation no later than 24 hours before the planned treatment without incurring costs (not applicable to treatments under a purchased special offer/stay package covered by a Reservation and apartment rental agreement with Czarny Kamień RESORT & SPA). Cancellation must be reported at the Reception of Czarny Kamień RESORT & SPA, by email at spa@czarnykamien.com or by phone at +48-533-352-214. Canceling less than 24 hours before the scheduled treatment or no-show due to the Guest’s fault will result in a charge of 110 PLN for each commenced reserved hour of treatment. The no-show fee is 110 PLN.
  10. Payment for SPA cabinet services must be made at the reception of Czarny Kamień RESORT & SPA after the treatment.

§4 Liability

  1. The Guest is liable for damages caused by their fault, including damages caused by minors under their care, according to general principles under applicable law, especially the Civil Code.
  2. Czarny Kamień RESORT & SPA is responsible towards the Guest for proper service execution in the SPA cabinet under applicable law, including the Civil Code.
  3. SPA staff is not responsible for personal belongings left in the SPA area.

§5 Personal data protection

  1. The administrator of Guests' personal data processed in the massage cabinet (hereinafter: "Personal Data") is ART-DOM Developer sp. z o.o. based in Jelenia Góra, Szkolna Street 5/10, 58-500 Jelenia Góra, KRS0000306359, email: biuro@artdomdeveloper.pl.
  2. Personal Data is processed by the administrator for the following purposes:
    1. concluding and performing service contracts (legal basis: Art. 6(1)(b) GDPR),
    2. handling complaints (legal basis: Art. 6(1)(b) GDPR),
    3. establishing, pursuing, or defending against claims (legal basis: Art. 6(1)(f) GDPR), constituting a legitimate interest of the administrator.
  3. The administrator of health-related Personal Data is ART-DOM Developer sp. z o.o. based in Jelenia Góra, Szkolna Street 5/10, 58-500 Jelenia Góra, KRS0000306359, and their processing basis is the Guest's consent given for service contract performance (legal basis: Art. 9(2)(a) GDPR).
  4. Detailed information about all purposes of Personal Data processing and protection principles is contained in the massage cabinet consultation card, which the Guest completes before using SPA services.
  5. Providing Personal Data indicated on the consultation card, including health data and consent to their processing, is voluntary but necessary to use SPA cabinet services. Failure to provide a surname, apartment number, treatment type, and preferred date prevents treatment reservation.
  6. All matters concerning Personal Data processing by administrators can be addressed via email at biuro@czarnykamien.pl or in writing to ART-DOM Developer sp. z o.o., Jelenia Góra, Szkolna 5/10, 58-500 Jelenia Góra, KRS0000306359, email spa@czarnykamien.pl.
  7. Everyone whose Personal Data is processed has the right to:
    1. access their Personal Data,
    2. rectify their Personal Data,
    3. erase their Personal Data,
    4. restrict processing of their Personal Data,
    5. object to processing of their Personal Data,
    6. data portability,
    7. withdraw consent at any time if processing is based on consent, without affecting legality of processing before withdrawal.
  8. In case of personal data protection violations, the data subject may file a complaint with the President of the Personal Data Protection Office. Complaints can be filed in person at the Office, Stawki 2, 00-986 Warsaw, or sent to the office address indicated above.

§6 Final provisions

  1. The term "Czarny Kamień RESORT & SPA" used in the Regulations means – depending on context – either the Czarny Kamień RESORT & SPA facility or the company managing the Parking as specified in §1(2) of the Regulations.
  2. Treatments purchased under special offers/stay packages, covered by Reservations and purchased under apartment rental agreements with Czarny Kamień RESORT & SPA, are not exchangeable for other services available in the SPA cabinet.
  3. Treatments purchased under special offers/stay packages (package treatments), covered by Reservations and purchased under apartment rental agreements with Czarny Kamień RESORT & SPA, are carried out between 10:00 AM and 3:00 PM.
  4. Prices of treatments purchased under special offers/stay packages, covered by Reservations and purchased under apartment rental agreements with Czarny Kamień RESORT & SPA, are not subject to discounts arising from simultaneous promotional campaigns concerning SPA cabinet services.
  5. Treatments purchased as packages and unused at the agreed date expire.
  6. Matters not regulated in the Regulations, including complaint procedures, are governed by the provisions of the Czarny Kamień RESORT & SPA Regulations and applicable law, including the Civil Code. The Czarny Kamień RESORT & SPA Regulations are especially available at the reception of Czarny Kamień RESORT & SPA and on the website at www.czarnykamien.pl.
  7. All wishes, comments, complaints can be submitted, especially at the reception of Czarny Kamień RESORT & SPA, directly or by phone at 75 769 38 54 or 536 150 150, as well as by email at recepcja@czarnykamien.com or in writing at Czarny Kamień RESORT & SPA, ul. Wojska Polskiego 11, 58-580 Szklarska Poręba.
  8. The Regulations are effective from 01.08.2024.
