To make and process a reservation at Czarny Kamień Resort & SPA, provide services during the stay, handle complaints concerning contract performance and for marketing purposes (consent).

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as GDPR, we inform you that:

  • The Controller of your personal data is Art.-Dom Developer Spółka z o.o., ul. Szkolna 5/10, 58-500 Jelenia Góra.
  • Contact the Controller regarding your personal data: czarny.kamien.resort.spa@wp.pl
  • Your personal data are processed pursuant to Article 6 of the GDPR.
  • We process your personal data as necessary to perform the contract and take steps before entering into it, namely the apartment rental agreement (parahotel service). We process your data to accept your reservation and enable use of services at Czarny Kamień Resort & SPA and, where consent was given, for marketing purposes.
  • The Controller also obtains personal data from booking portal partners (Booking.com, HRS, event organisers, etc.) where you have previously given appropriate consent.
  • Children’s data, such as name, surname and date of birth (or age), are collected only from parents or legal guardians to determine age and applicable discounts and for statistical purposes. Data are collected when making a reservation and booking an apartment at the Property.

This purpose also includes:

  • pursuing the Property’s claims for damage caused by a Guest, or defending against a Guest’s claims against the Property,
  • documenting the contract/service performed for tax purposes,
  • ensuring top-quality services.

We process personal data collected through monitoring because this is necessary to protect your vital interests and those of other Guests and persons on the Property’s premises.

The Data Controller relies on a legitimate interest: website analytics, visit analysis, and contact with the company’s customers and potential customers.

If you consent to marketing processing, we process personal data for this purpose, namely sending Guests marketing information and offers for our products and services.

The legal basis for processing is fulfilment of the condition in Article 6 of the above Regulation, in particular:

  • data are necessary to perform the contract (conclusion and performance of the apartment rental agreement (parahotel service), including accepting a reservation and using services at Czarny Kamień Resort & SPA),
  • consent – processing personal data for marketing purposes; consent may be withdrawn at any time,
  • protection of other individuals’ vital interests and the controller’s legitimate purpose,
  • of the Guest's personal data through monitoring.

Providing personal data (making a reservation, concluding a rental agreement, staying at Czarny Kamień Resort &SPA) is voluntary; however, refusal may result in the agreement not being performed.

Data recipients:

The Property provides personal data to:

  • IT service providers at the Property,
  • the accounting firm.

We may provide personal data to:

  • entities supporting us in providing electronic services (including payment services),
  • entities providing consulting or auditing services,
  • entities supporting marketing campaigns
  • public authorities concerning fraud and abuse.

Data retention period:

  • Your personal data will be stored for 5 years, or, if you consent to marketing, until you withdraw that consent.

Rights

  • Anyone whose data is processed has the right to request access to, rectification, erasure or restriction of processing of their personal data, data portability, and to object to processing.
