RULES OF CZARNY KAMIEŃ RESORT & SPA

§1 General provisions

  1. These Rules (the “Rules”) specify the services provided by Czarny Kamień RESORT & SPA, liability and rules for staying at Czarny Kamień RESORT & SPA. They form an integral part of the agreement concluded by signing the registration card or performing the actions described in §2 (the “Agreement”). The Rules also specify the types, scope and conditions of electronic services provided by Czarny Kamień RESORT & SPA.
  2. Czarny Kamień RESORT & SPA, located at ul. Wojska Polskiego 11, 58-580 Szklarska Poręba, is operated by ART-DOM Developer sp. z o.o., with its registered office in Jelenia Góra at ul. Szkolna 5/10, 58-500 Jelenia Góra, whose registration files are held by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division of the National Court Register, under KRS0000306359, NIP: 6112646271, REGON: 020715829.

§2 Apt. reservations & Agreement conclusion

  1. At https://www.czarnykamien.pl/ (the “Website”), Czarny Kamień RESORT & SPA provides a booking system (the “Booking System”) enabling remote apartment reservations (a “Reservation”) and conclusion of an Agreement with Czarny Kamień RESORT & SPA.
  2. To make a Reservation, the person booking must follow the instructions in the Booking System, including selecting the service(s) of interest according to their description and price by clicking “Rezerwuj” under the relevant service, completing the booking form, then confirming and submitting the Reservation by clicking “REZERWUJ z obowiązkiem zapłaty”.
  3. The person booking may select an offered service, including a standard stay or stay package, as well as additional services. Information on prices and service features is provided in the Booking System. Prices shown there are in Polish zloty and are gross prices including VAT. Apartment rental prices include utilities (gas, electricity and water) but exclude the local fee charged to Guests staying for more than one day for leisure, training or tourism in Szklarska Poręba, pursuant to resolutions of the Szklarska Poręba Municipal Council on the local fee. The fee amount and rules for its calculation and collection are available on the Szklarska Poręba Municipal Office website at www.miasto.szklarskaporeba.pl
  4. The person booking completes a booking form in which they: a. provide their first and last name, email address and telephone number; b. provide invoice details if an invoice is required; c. select a payment method.
  5. Making a Reservation requires the person booking to provide the personal data marked as mandatory in the booking form. Providing this data is voluntary but necessary to make a Reservation.
  6. Making a Reservation requires reading and accepting the booking rules and cancellation terms by checking the relevant box in the booking form. Failure to accept the Rules prevents the Reservation from being made.
  7. The person booking may change the data entered in the booking form until clicking “REZERWUJ z obowiązkiem zapłaty”.
  8. After selecting the service(s) and completing the booking form, the Booking System displays a Reservation summary, including whether and how much of an advance payment (the “Advance”) or the full price must be paid to make the Reservation, according to the selected service terms.
  9. The person booking makes a Reservation by clicking “REZERWUJ z obowiązkiem zapłaty” in the Booking System and paying the Advance or full price, depending on the selected service terms. If an Advance is paid, the remaining amount is payable by the Guest at the Czarny Kamień RESORT & SPA reception on arrival, before the stay begins.
  10. Czarny Kamień RESORT & SPA offers the following reservation payment methods: a. electronic payment by payment card, instant online transfer or “Blik” through the external Przelewy24 payment system; b. traditional bank transfer; c. for stays and/or SPA treatments scheduled within less than 24 hours, electronic payment via BLIK. The person booking provides the BLIK code by telephone in accordance with security rules; payment is then authorised on the service provider’s terminal via the external E-Service payment system. The payment methods may not be combined.
  11. If electronic payment is selected (by payment card, instant online transfer or “Blik”), the person booking must pay the Advance or full price immediately after clicking “REZERWUJ z obowiązkiem zapłaty”, according to the selected service terms. If traditional bank transfer is selected, payment must be made within 48 hours of receiving Czarny Kamień RESORT & SPA’s email Confirming Receipt of the Preliminary Reservation referred to in paragraph 14 below. Failure to pay results in automatic cancellation.
  12. If the stay and/or SPA service is scheduled within less than 24 hours, the person booking must pay the Advance or full price immediately during the telephone call via BLIK. The BLIK code is provided by telephone in accordance with security rules, and payment is then authorised on the service provider’s terminal via the external E-Service payment system.
  13. The terminal on which the BLIK code is entered is operated by the external E-Service payment system, registered in the National Court Register (KRS) under no. 0000490970. Its full name is Centrum Elektronicznych Usług Płatniczych E-Service Spółka z Ograniczoną Odpowiedzialnością; NIP: 1181477610; REGON: 016107240.
  14. Electronic payments by payment card, instant online transfer and “Blik” through the external Przelewy24 payment system are handled by PayPro Spółka Akcyjna, registered office: ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto i Wilda, 8th Commercial Division, under KRS 0000347935, NIP: 7792369887, REGON: 301345068, entered in the register of domestic payment institutions maintained by the Polish Financial Supervision Authority under entity no. UKNF IP24/2014 as a domestic payment institution operating under the trade name “Przelewy24”, pursuant to the rules available at https://www.przelewy24.pl/regulamin.
  15. If payment via the external Przelewy24 system is selected, the person booking will be redirected from the Booking System to that payment system’s website during the Reservation process. After being redirected, they must follow the procedure provided on the Przelewy24 website to make payment.
  16. If traditional bank transfer is selected, Czarny Kamień RESORT & SPA will immediately send, after the person booking clicks “REZERWUJ z obowiązkiem zapłaty”, an email to the address provided in the booking form Confirming Receipt of the Preliminary Reservation, including the relevant bank account number. Receipt of this email does not constitute the Confirmation of Acceptance of the Reservation referred to in paragraph 17 below or conclusion of an Agreement between Czarny Kamień RESORT & SPA and the person booking.
  17. After the Reservation is made (by clicking “REZERWUJ z obowiązkiem zapłaty” in the Booking System and paying the Advance or full price, according to the selected service terms), Czarny Kamień RESORT & SPA will immediately send an email confirming acceptance of the Reservation (the “Confirmation of Acceptance of the Reservation”) to the address provided in the booking form. Upon receiving this confirmation, an Agreement is concluded between Czarny Kamień RESORT & SPA and the person booking, who becomes a Guest of Czarny Kamień RESORT & SPA (the “Guest”). The Agreement is confirmed, provided, recorded and secured by sending the Confirmation of Acceptance of the Reservation, together with information confirming its terms. Czarny Kamień RESORT & SPA also records and secures the Agreement in its IT system.
  18. The Agreement between the Guest and Czarny Kamień RESORT & SPA includes use, for the period specified by the Guest when making the Reservation, of the rented apartment and the following free additional services:
    1. the swimming pool, jacuzzi & sauna area,
    2. the gym,
    3. the children’s playroom,
    4. the Multiroom games room,
    5. the car park,
    6. daily cleaning service,
    7. stay and travel information,
    8. Internet access.

The rules and scope of the additional services listed in points a)–h) above are set out in the regulations attached to these Rules.

  1. For additional services other than those listed in paragraph 18 above or not included in the Reservation, the Guest pays directly at the Czarny Kamień RESORT & SPA reception according to the price list. The price list is available at reception and on the Website at www.czarnykamien.pl.
  2. The terms of the service offered by Czarny Kamień RESORT & SPA and selected by the Guest in the made and confirmed Reservation determine whether and when the Guest may withdraw from the Agreement without cost (cancel the confirmed Reservation), subject to paragraph 21 below. Where cost-free withdrawal is possible, the Guest may submit a withdrawal statement, for example in writing to Czarny Kamień RESORT & SPA, ul. Wojska Polskiego 11, 58-580 Szklarska Poręba, or by email to recepcja@czarnykamien.com.
  3. Provisions in the Terms and Conditions or service terms offered by Czarny Kamień RESORT & SPA limiting the cancellation of a confirmed Reservation (withdrawal from or termination of the Agreement) or refund of amounts paid towards the Reservation do not limit or exclude the Guest’s rights to cancel the Reservation and obtain a refund under mandatory law, or rights available where the Agreement is not performed for reasons attributable to Czarny Kamień RESORT & SPA or due to force majeure, including rights arising from payment of a deposit, as specified in Article 394 of the Act of 23 April 1964, the Civil Code (consolidated text: Journal of Laws of 2023, item 1610, as amended).
  4. If the Guest exercises the right to withdraw from the Agreement (cancel a confirmed Reservation), Czarny Kamień RESORT & SPA will refund payments received to the bank account indicated by the Guest within 10 business days.
  5. Remote reservations and Agreement-making with Czarny Kamień RESORT & SPA are also possible:

    2. by email at Czarny Kamień RESORT & SPA: recepcja@czarnykamien.com
  6. For reservations made by telephone or email directly with Czarny Kamień RESORT & SPA, Czarny Kamień RESORT & SPA will send the Guest an offer by email containing the agreement terms. In particular, the offer states its validity period, which is also the deadline for paying the Advance or full price (depending on the service terms offered by Czarny Kamień RESORT & SPA), and the available payment methods (electronic or traditional bank transfer). The offer is accepted and the Agreement between the Guest and Czarny Kamień RESORT & SPA is concluded when the Advance or full price is paid, depending on the offer terms, during its validity period. This paragraph applies accordingly to such Agreement.
  7. For reservations made through intermediaries, e.g. booking portals, the rules for making and cancelling reservations follow the terms and offers applicable through those intermediaries.
  8. The Guest has no right to withdraw from a distance Agreement with Czarny Kamień RESORT & SPA under this paragraph, subject to the exceptions in sections 20 and 21 above, pursuant to Article 38(12) of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2023, item 2759, as amended).

§ 3 Stay at Czarny Kamień RESORT & SPA

  1. Registration of the Guest’s stay at Czarny Kamień RESORT & SPA requires presenting reception staff with a valid photo ID for identification, completing and signing the registration card provided by reception staff. If the Guest has not paid the full price of the reserved service(s) when booking, registration also requires payment of the outstanding balance at the Czarny Kamień RESORT & SPA reception.
  2. The apartment is rented by the day. The rental day begins at 16:00 on the date stated in the Agreement as the start of the stay and ends at 11:00 on the Guest’s departure date.
  3. At the Guest’s request and subject to apartment availability, Czarny Kamień RESORT & SPA may, for an extra fee, extend the rental day referred to in section 2 above or extend the stay. Extending the day until 19:00 incurs a fee of 50% of the average stay price stated in the Agreement with Czarny Kamień RESORT & SPA. Extending it by more than 8 hours requires payment of 100% of that average price. The Guest must request an extension at reception by 11:00 on the day the original rental period ends. Availability depends on occupancy and is not guaranteed.
  4. Leaving during the rental day referred to in section 2 above does not reduce the amount due for the entire stay, unless mandatory law provides otherwise.
  5. The Guest must pay for all services and goods ordered or used during the stay before departure, at the latest when checking out of Czarny Kamień RESORT & SPA.
  6. Guest may not transfer apartment to a third party.
  7. The number of persons staying in the apartment may not exceed the number specified in the Agreement with Czarny Kamień RESORT & SPA based on the Guest’s reservation.
  8. After registering at Czarny Kamień RESORT & SPA, the Guest should inspect the apartment’s equipment and keep it in its original condition until departure. Any damage must be reported immediately to Czarny Kamień RESORT & SPA reception.
  9. Czarny Kamień RESORT & SPA is intended for leisure. Quiet hours apply from 22:00 to 7:00 the following day. The Guest and persons using Czarny Kamień RESORT & SPA services must not disturb quiet hours or other Guests’ peaceful stay and rest. The Guest may not organise social gatherings or parties in the apartment. Czarny Kamień RESORT & SPA may stop providing services to a Guest who persistently breaches these rules despite a warning from its staff.
  10. Czarny Kamień RESORT & SPA may refuse admission to a person who during a previous stay seriously breached the Terms and Conditions, damaged the property of Czarny Kamień RESORT & SPA, other Guests or its employees, or otherwise disrupted the operation of Czarny Kamień RESORT & SPA.
  11. Persons not registered to stay at Czarny Kamień RESORT & SPA may visit the apartment from 7:00 to 22:00.
  12. Pets are not permitted at Czarny Kamień RESORT & SPA. If a Guest, a person for whom the Guest is responsible, or a visitor brings an animal onto the premises, the Guest may be charged [1000] zł for cleaning and deodorising the apartment, unless the cost of removing the effects of the animal’s stay is higher.
  13. Smoking tobacco products and electronic cigarettes is prohibited at Czarny Kamień RESORT & SPA under the Act of 9 November 1995 on the protection of health against the effects of tobacco use and tobacco products (consolidated text: Journal of Laws of 2023, item 700). The ban also covers all apartments and their balconies. If the Guest, a person for whom the Guest is responsible, or a visitor breaches the ban, the Guest may be charged 2000 zł for deodorising the premises, unless the cost of removing the effects is higher, in particular where the breach triggers the fire alarm and fire brigade intervention.
  14. For losing or failing to return the apartment access card after the stay, the Guest may be charged 30 zł for issuing a replacement card.
  15. For safety reasons, especially in apartments, possessing, storing or using dangerous charges, weapons, ammunition, flammable, explosive or illuminating materials, including fireworks, is prohibited at Czarny Kamień RESORT & SPA. Devices or items that may risk damage to the property of Czarny Kamień RESORT & SPA or Guests are also prohibited.
  16. For fire safety reasons, using heaters or similar devices not provided as apartment equipment is prohibited in apartments.
  17. The Guest must not cause unpleasant odours to escape from the apartment.
  18. Soliciting, door-to-door sales and gambling are prohibited at Czarny Kamień RESORT & SPA.
  19. The Guest may not make any changes to the apartment or its equipment.
  20. Rollerblades, roller skates, skateboards, bicycles, scooters and other personal transport devices may not be used in the Czarny Kamień RESORT & SPA building. Drones are also prohibited.
  21. In winter, wearing ski boots in the Czarny Kamień RESORT & SPA building is strictly prohibited.

§ 4 Czarny Kamień RESORT & SPA Services.

  1. Czarny Kamień RESORT & SPA offers Guests:
    1. conditions for complete and unrestricted rest under the Agreement,
    2. a safe stay, including confidentiality of Guest information,
    3. professional and courteous service for the services offered,
    4. apartment cleaning as specified in sections 2 and 3 below, and necessary equipment repairs during the Guest’s absence or, if present, only with the Guest’s consent and at their request,
    5. technically efficient service; if faults cannot be repaired immediately, Czarny Kamień RESORT & SPA will make reasonable efforts to alleviate the inconvenience where possible,
    6. storage of money, securities and valuables in deposit during the Guest’s stay in the Czarny Kamień RESORT & SPA building, subject to § 5 section 3 of the Terms and Conditions.
  2. Daily cleaning includes routine cleaning of all rooms in the Guest’s rented apartment, limited to visible places and surfaces. For rentals of at least six days, it also includes one change of towels and bed linen on the third rental day. For rentals shorter than six days, changing towels and bed linen is an additional paid service under the additional services price list.
  3. Full cleaning includes comprehensive cleaning of all apartment rooms and changing towels and bed linen.
  4. The Guest may use these free of charge:
    1. the swimming pool, jacuzzi & sauna area,
    2. the gym,
    3. the children’s playroom,
    4. the Multiroom games room,
    5. the car park,
    6. daily cleaning service,
    7. Internet access.

The rules and scope of the additional services listed in points a)–g) above are set out in regulations attached to these Terms and Conditions.

  1. At the Guest’s request, Czarny Kamień RESORT & SPA provides paid additional services; types, scope and prices are listed in the additional services price list in every apartment and at Czarny Kamień RESORT & SPA reception.

§ 5 Liability

  1. Czarny Kamień RESORT & SPA is liable to the Guest under generally applicable law, including the Civil Code. In particular, Czarny Kamień RESORT & SPA is liable for the loss of or damage to items brought in by a person using its services, unless the damage resulted from the item's nature, force majeure, or solely from the fault of the injured party or a person accompanying, employing or visiting them.
  2. The Guest should report the damage at the Czarny Kamień RESORT & SPA reception immediately after learning of it.
  3. Money, securities and valuables, in particular jewellery and items of scientific or artistic value, should be kept in the safe in each apartment or deposited by the Guest at the Czarny Kamień RESORT & SPA reception. Czarny Kamień RESORT & SPA may refuse to store such items only if they threaten safety, are excessively valuable for its size or standard, or occupy too much space.
  4. At Czarny Kamień RESORT & SPA, minors under 13 must remain under the constant supervision of a legal guardian.
  5. The Guest is liable for damage caused through their fault, including damage caused by a minor in their care and damage caused through the fault of visitors, under generally applicable law, in particular the Civil Code.
  6. For safety reasons, whenever leaving the apartment, the Guest should secure it against third-party access by locking the doors and windows, switch off the TV, turn off the lights, close the taps, and carefully safeguard the apartment access card.
  7. In the event of a gross violation of the Regulations, Czarny Kamień RESORT & SPA may refuse to continue providing services to the person in breach. That person must immediately follow staff instructions, settle charges for services already provided and leave Czarny Kamień RESORT & SPA.

§ 6 Return of items left behind

  1. Personal items left in the apartment by a departing Guest will be sent to the address indicated by the Guest at their expense. If the Guest gives no instructions for sending the items, Czarny Kamień RESORT & SPA will store them at the owner's expense for one month from the notice requesting collection; thereafter, ownership will pass to Czarny Kamień RESORT & SPA.
  2. If the Guest cannot be notified to collect an item left in the apartment, Czarny Kamień RESORT & SPA will store it at the owner's expense for two months from the date it was found; thereafter, ownership will pass to Czarny Kamień RESORT & SPA.
  3. Due to their nature, food items left in the apartment by a departing Guest will be stored for 24 hours after being found.

§ 7 Personal data protection

Czarny Kamień RESORT & SPA's personal data processing rules are set out in the Privacy Policy at https://www.czarnykamien.pl/polityka-prywatnosci and at the Czarny Kamień RESORT & SPA reception.

§ 8 Complaints

  1. Czarny Kamień RESORT & SPA is responsible for the service's conformity to the Agreement and must provide it defect-free.
  2. Complaints concerning service provision, including operation of the Website and Booking Service, may be submitted.
  3. A complaint may be submitted, for example, by email to recepcja@czarnykamien.com. or in writing to: Czarny Kamień RESORT & SPA ul. Wojska Polskiego 11, 58-580 Szklarska Poręba.
  4. For efficient processing, a complaint should include in particular: the complainant's name and contact details; information and circumstances concerning the complaint, especially the type and date the defect was identified; and the complainant's request. The above is only an example. A complainant need not follow it, and omission of the recommended description does not affect the complaint's effectiveness.
  5. Czarny Kamień RESORT & SPA will consider the complaint and respond within 14 days of receiving it. The response will be provided, in particular, in writing or to the email address specified in the complaint.

§ 9 Out-of-court consumer dispute resolution

  1. The body authorised to conduct proceedings on out-of-court consumer dispute resolution concerning consumer Agreements is the Trade Inspection. Its tasks in this area, including organising and conducting permanent arbitration courts, are performed by locally competent provincial Trade Inspection inspectors.   2. Czarny Kamień RESORT & SPA informs that an online platform for amicable dispute resolution between consumers and businesses at EU level (ODR platform) is available at http://ec.europa.eu/consumers/odr/ and may be used by consumers. The ODR platform is an interactive website through which consumers may submit complaints. Czarny Kamień RESORT & SPA also provides its contact email: recepcja@czarnykamien.com.
  3. Consumers may obtain free assistance in resolving an individual dispute with Czarny Kamień RESORT & SPA from Municipal or County Consumer Ombudsmen, or a consumer-protection organisation such as the Consumers' Federation: www.federacja-konsumentow.org.pl. A list of Consumer Ombudsmen and their contact details is available at the Office of Competition and Consumer Protection website: www.uokik.gov.pl/rzecznicy.
  4. A contact point has been established at the Office of Competition and Consumer Protection to provide information on amicable proceedings. It may be contacted, for example, by telephone at 22 55 60 332 or 22 55 60 333, or by email at kontakt.adr@uokik.gov.pl.
  5. Detailed information on out-of-court dispute resolution and access rules is available in particular on the Office of Competition and Consumer Protection websites: www.polubowne.uokik.gov.pl, www.uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php
  6. Available out-of-court dispute resolution methods may be used after completing the complaint procedure and are voluntary; both parties must consent to the proceedings.

§ 10 Types and terms of electronic services

  1. Czarny Kamień RESORT & SPA strives to ensure that the Website at www.czarnykamien.pl, including the Booking System, can be used with all popular browsers, operating systems, device types and Internet connections. Minimum technical requirements for using the Website are:
    1. a device enabling Internet use and Internet access,
    2. a browser at least: Microsoft Internet Explorer 11 or later with ActiveX enabled, Microsoft Edge 17 or later with ActiveX enabled, Mozilla Firefox 68 or later, Opera 58 or later, Google Chrome 75 or later, Safari 15.1 or later,
    3. software for generating and viewing PDF files,
    4. minimum screen resolution of 1280x1024.

To make a Reservation and conclude an Agreement as set out in § 2 of the Regulations, in addition to meeting the technical requirements above, an active email account capable of sending and receiving email and an active telephone number are required.

  1. Czarny Kamień RESORT & SPA takes technical and organisational measures appropriate to the level of risk to secure communications and data transmitted via the Website, especially against unauthorised access to or alteration of data sent over the Internet. It secures data transmission via the Website using SSL (SecureSocketLayer).
  2. Upon request sent to recepcja@czarnykamien.com, Czarny Kamień RESORT & SPA will provide up-to-date information on specific risks related to using the Website and explain the function and purpose of software or data not forming part of electronically provided service content, introduced by Czarny Kamień RESORT & SPA into the ICT system used by the Website user.
  3. Czarny Kamień RESORT & SPA informs that the public nature of the Internet and use of electronic services may expose Website users' data to unauthorised acquisition or alteration. To maintain safe Website use, appropriate technical measures are recommended to minimise these risks, especially antivirus and identity-protection software.
  4. A Website user must:
    1. use the Website in accordance with applicable law and the Regulations, respecting personal rights, copyrights and intellectual property of Czarny Kamień RESORT & SPA and third parties,
    2. use the Website in accordance with good practices and social norms,
    3. not provide or transmit unlawful content via the Website,
    4. not use third parties' personal data without legally required authorisation or their consent,
    5. use the Website without disrupting its operation,
    6. not send unsolicited commercial information (spam) via the Website.
  5. Where Website use requires specified data, the user must provide complete, current, truthful and non-misleading data.
  6. Czarny Kamień RESORT & SPA ensures operation of its ICT system, enabling Website users to terminate use of the electronic service free of charge at any time.
  7. Via the Website, Czarny Kamień RESORT & SPA provides these electronic services:
    1. “Browsing”,
    2. “Booking System”,
    3. “Contact Form”.
  8. Electronic services are provided free of charge.
  9. Electronic services are provided 7 days a week, 24 hours a day.
  10. The “Browsing” electronic service enables users to view and read content on the Website.
    1. To use the “Browsing” electronic service, the Website user should enter the Website address in a web browser on an Internet-enabled device and, as appropriate for that browser, open the address. Once the Website is displayed, its content may be viewed and read.
    2. The agreement for the “Browsing” electronic service is concluded when any Website page is displayed at the user’s request. The “Browsing” service is provided on a one-off basis: the agreement is concluded each time for the period of viewing and reading content on the Website and ends immediately after Czarny Kamień RESORT & SPA has provided it, or earlier when use of the service ends. The Website user may end use of the “Browsing” electronic service at any time by closing the Website in the web browser.
  11. The “Contact Form” electronic service enables users to send an electronic message to Czarny Kamień RESORT & SPA using the form available on the Website.
    1. To use the “Contact Form” electronic service, the Website user should complete the contact form on the Website, stating the message and providing an email address, then click the “Send Form” button. Providing an email address is necessary to provide the “Contact Form” electronic service. Czarny Kamień RESORT & SPA will reply to the message at the email address provided.
    2. The agreement for the “Contact Form” electronic service is concluded when the “Send Form” button is clicked. The service is provided on a one-off basis and ends immediately after Czarny Kamień RESORT & SPA has provided it, i.e. after the completed contact form is sent, or earlier when the Website user ends use of the Service. The user may end use of the “Contact Form” service at any time by stopping entry of content in the contact form or closing the Website in the web browser without sending the message to Czarny Kamień RESORT & SPA.
  12. The “Booking System” electronic service enables remote booking and conclusion of an agreement with Czarny Kamień RESORT & SPA. The service is provided on a one-off basis and ends when a booking is submitted by clicking “I book and pay” or when the Website is closed in the web browser without submitting a booking. Detailed rules for providing the “Booking System” electronic service are set out in § 2 of the Terms and Conditions.
  13. Czarny Kamień RESORT & SPA strives to ensure the proper and uninterrupted operation of the Website. In special cases, including a failure or the need to maintain, modify or update the ICT system, Czarny Kamień RESORT & SPA reserves the right to interrupt access to the Website, including electronic services, or reduce access quality, for the following reasons:
    1. the need for technical maintenance, modification or updating of the Website, for no more than 48 hours per month,
    2. events affecting the security or stability of Czarny Kamień RESORT & SPA’s ICT system, for the time necessary to restore its security and stability,
    3. reasons beyond Czarny Kamień RESORT & SPA’s control, including force majeure, i.e. an unforeseeable and unavoidable external event independent of Czarny Kamień RESORT & SPA, in particular natural disasters, fires or floods preventing or limiting use of the Website or electronic services, for the duration of such causes or restoration measures.
  14. Czarny Kamień RESORT & SPA will give advance notice of planned restrictions on access to the Website and electronic services by posting a notice on the Website, and will strive to ensure that such restrictions are not burdensome for users wishing to use them.

§ 11 Final provisions

In these Terms, “Czarny Kamień RESORT & SPA” means, as context requires, the Czarny Kamień RESORT & SPA property or the company specified in § 1(2).

  1. The agreement with Czarny Kamień RESORT & SPA is in Polish.
  2. The Terms and Conditions are available free of charge on the Website at www.czarnykamien.pl in a form enabling their content to be obtained, stored and reproduced using an ICT system, as well as at the Czarny Kamień RESORT & SPA reception and in every apartment.
  3. Appendices to the Terms and Conditions:

    3. Appendix 3 – Outdoor sauna and hot tub regulations,

    9. Appendix 9 – Gift Voucher purchase rules
    10. Appendix 10 – Child protection standards,
    11. Appendix 10 – Minor protection standards.
  4. Terms and Conditions take effect 1 August 2024.
