The Website uses two main types of cookies: “session” and “persistent” cookies. 13. Your personal data are processed under Article 6 of the GDPR.

14. We process your personal data because this is necessary to perform the contract and take appropriate steps before concluding it; the contract is for apartment rental (a para-hotel service). We process your data to accept your reservation at the property and enable your use of services at Czarny Kamień Resort & SPA and, where consent was given, for marketing purposes.

15. The controller also obtains personal data from booking portal partners (Booking.com, HRS, event organisers, etc.) if you previously gave appropriate consent.

16. Children's data, such as name, surname and date of birth (or age), are collected only from parents or legal guardians to determine age and applicable discounts, and for statistical purposes. Data are collected when making a reservation and when reserving an apartment at the property.

This purpose also includes:

  • pursuing potential claims by the property for damage caused by a Guest, or defending against claims by a Guest against the property,
  • documenting the concluded contract/service performed for tax purposes,
  • ensuring highest quality of services.

17. We process personal data collected through monitoring because this is necessary to protect your vital interests and those of other Guests and persons on the property's premises. The Data Controller relies on a legitimate interest: website analytics, visit analysis, and contact with the company's customers and potential customers. If consent is given to process data for marketing purposes, we process personal data accordingly, namely by sending Guests marketing information and offers for our products and services. The legal basis is fulfilment of the condition in Article 6 of the above Regulation, in particular:

  • data are necessary to perform the contract (concluding and performing the apartment rental contract (para-hotel service), meaning accepting a reservation at the property and using services provided at Czarny Kamień Resort & SPA),
  • consent – processing personal data for marketing purposes; consent may be withdrawn at any time,
  • protection of the vital interests of other natural persons, and the controller's legitimate
  • processing Guest's personal data via monitoring.

18. Providing personal data (making a reservation, concluding a rental contract, staying at Czarny Kamień Resort & SPA) is voluntary; however, refusal may result in refusal to perform the contract. Data recipients: the property provides personal data to:

  • IT service companies at the property,
  • an accounting firm.

We may share personal data:

  • entities supporting our electronic services (including payment services),
  • consulting or auditing service providers,
  • marketing campaign partners
  • public authorities in fraud and abuse cases.

Data processing period:

Your personal data will be stored for 5 years, or, if you consent to marketing, until you withdraw consent.

Rights

Anyone whose data is processed may request access to, correction, deletion or restriction of processing of their personal data, data portability, and may object to processing.
