13. Your personal data is processed on the basis of Article 6 of the GDPR.
14. We process your personal data because it is necessary to perform the contract and take appropriate action before concluding the contract, namely an apartment rental agreement (para-hotel service). We process your personal data to accept your reservation at the property and to enable you to use the services provided at Czarny Kamień Resort & SPA and, where consent has been given, for marketing purposes.
15. The controller also obtains personal data from partners of booking portals (Booking.com, HRS, event organisers, etc.), if you have previously given the appropriate consent.
16. Children’s data, such as first name, surname and date of birth (or age), is collected only from their parents or legal guardians to determine their age and applicable discounts, and for statistical purposes. The data is collected when making a reservation and when reserving an apartment at the Property.
Furthermore, this purpose includes:
- pursuing any claims by the Property in connection with damage caused by a Guest, or defending against a Guest’s claims against the Property,
- documenting the concluded contract/service performed for tax purposes,
- ensuring the highest quality of services.
17. We process personal data collected through monitoring because this is necessary to protect your vital interests and those of other Guests and persons staying on the Property. The Personal Data Controller relies on a legitimate interest consisting of website analytics, visit analysis, and contact with the company’s customers and potential customers. If consent is given to process data for marketing purposes, we process personal data for this purpose, i.e. we send Guests marketing information and offers concerning our products and services. The legal basis for processing is fulfilment of the condition specified in Article 6 of the above-mentioned regulation, in particular:
- the data is necessary to perform the contract (concluding and performing an apartment rental agreement (para-hotel service), understood as accepting a reservation at the property and using services provided at Czarny Kamień Resort & SPA),
- consent – processing personal data for marketing purposes; consent may be withdrawn at any time,
- protection of the vital interests of other natural persons and the controller’s legitimate purpose,
- processing the Guest’s personal data through monitoring.
18. Providing personal data (making a reservation, concluding a rental agreement, staying at Czarny Kamień Resort &SPA) is voluntary; however, refusal to provide data may result in refusal to perform the contract. Data recipients: the Property provides personal data to:
- companies providing IT services at the Property,
- the accounting company.
We may provide personal data to:
- entities supporting us in providing electronic services (providing payment services),
- entities providing consulting or auditing services,
- entities supporting marketing campaigns
- public authorities in cases of fraud and abuse.
Data processing period:
Your personal data will be stored for 5 years, or, where consent to processing for marketing purposes has been given, until consent is withdrawn.
Rights
Anyone whose data is processed has the right to request access to personal data, its rectification, erasure or restriction of processing, the right to data portability and to object to processing.
