  • The Service uses two main types of cookies: "session" cookies and "persistent" cookies. Session cookies are temporary files stored on the User's end device until logging out, leaving the website, or closing the software (web browser). Persistent cookies are stored on the User's end device for a period specified in the cookie parameters or until deleted by the User.
  • The following types of cookies are used within the Service:
  1. "necessary" cookies, enabling the use of services available within the Service, e.g., authentication cookies used for services requiring authentication within the Service;
  2. cookies used for security purposes, e.g., used to detect abuses regarding authentication within the Service;

For making reservations and processing reservations at Czarny Kamień Resort & SPA, providing services during the stay, handling complaints related to contract performance, and for marketing purposes (consent).

Acting in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 dated April 27, 2016, GDPR, we inform that:

  • Your personal data processing is based on Article 6 of GDPR.
  • We process your personal data because it is necessary to perform the contract and to take appropriate actions prior to concluding the contract, which is the apartment rental agreement (parahotel service). We process your personal data for accepting the reservation and for your use of services provided at Czarny Kamień Resort & SPA and if you consented - for marketing purposes.
  • The data is also obtained from partners of booking portals (Booking.com, HRS, event organizers, etc.) if you have previously given appropriate consent.
  • Children's data such as name, surname, and date of birth (or age) are collected only from their parents or legal guardians to determine their age and applicable discounts, as well as for statistical purposes. Data is collected while making reservations and when booking an apartment at the Facility.

Additionally, this purpose includes:

  • pursuing any claims of the Facility related to damage caused by the Guest, or defending against Guest claims related to the Facility,
  • documenting the concluded agreement/performed service for tax purposes,
  • ensuring the highest quality of services.

We process personal data collected via surveillance because it is necessary to protect your vital interests and the vital interests of other Guests and persons present on the Facility's premises.

The Data Controller relies on the legitimate interest which is internet analytics of the website, visit analysis, contact with clients and potential clients of the company.

In case of consent to data processing for marketing purposes, we process personal data for that purpose, i.e., we send Guests marketing information and offers about our products and services.

The legal basis for processing data is meeting the conditions set out in Article 6 of the above-mentioned regulation, in particular:

  • data is necessary for the performance of the contract (conclusion and execution of the apartment rental contract (parahotel service), meaning accepting reservation and use of services provided in Czarny Kamień Resort & SPA),
  • consent – processing personal data used for marketing purposes; this consent can be withdrawn at any time,
  • protection of vital interests of other individuals, as well as the justified purpose of the controller,
  • processing of the Guest's personal data by monitoring.

Providing personal data (making reservations, concluding the rental contract, staying at Czarny Kamień Resort & SPA) is voluntary, however refusal may result in refusal of contract execution.

Recipients of data:

The Facility provides personal data to the following entities:

  • companies providing IT services at the Facility,
  • accounting company.

We may transfer personal data to:

  • entities supporting us in providing electronic services (providing payment services),
  • entities providing consulting or audit services,
  • entities supporting marketing campaigns,
  • public authorities in fraud and abuse cases.

Data processing period:

  • Your personal data will be stored for 5 years and, if you consent to marketing data processing - until withdrawal of consent.

Rights

  • Anyone whose data is processed has the right to request access, rectification, deletion or limitation of their personal data processing, the right to data portability, and to object to processing.
